Grandparent visitation rights are well-established in Minnesota, both by statute and and case law. In fact, a recent Minnesota Supreme Court decision made it easier for grandparents to obtain visitation rights. When deciding grandparent visitation cases, the court will basically consider two factors: (1) the prior relationship between the grandparent and grandchild; and (2) the impact of grandparent visitation on the parent-child relationship. In all instances, the best interests of the child are of foremost consideration.
